Separation allowance according the Bayerische Trennungsgeldverordnung/Bavarian Separation Allowance Ordinance (BayTVG) is a benefit paid by the employer to support the necessary expenses incurred on the occasion of two households or the daily commute while retaining to the previous residence. In principle, you are entitled to separation allowance after you have been granted the allowance for relocation costs.
But it requires your willingness to move and a lack of housing at your place of appointment. You can prove a lack of housing by applying for a state employmee apartment at your commencement.
Steps - how to apply for separation allowance?
- Submitting an application for separation allowance to the Landesamt für Finanzen.
- Submitting an application for the allocation of a state employee apartment to the Housing Welfare Office or stating a reason that is preventing you from relocating.
- Showing your your efforts in finding a suitable housing for you and your family to the Landesamt für Finanzen.
If you do not have a lack of housing you might have a reason that is preventing you from relocating. However, you will still have to proof you willingness to move (by applying for the allocation of a state employee apartment, showing your search activities, etc.) at the time of taking up the professorship.
You can also apply for separation allowance if you are willing to move but one of the following reasons according § 2 Abs. 2 Nr.1-7 BayTGVprevents you from moving:
- Temporary serious illness of the applicant or their family members for up to one year
- Employment prohibitions for the applicant or a family member
- School or vocational training of a child until the end of the school or training year. If the child is in the penultimate year of a secondary school education or in the penultimate year of vocational training, the period shall be extended until the end of the following school or training year
- School or vocational training of a severely disabled child until the end of the training, as long as this cannot be continued at the new place of employment or residence or within reachable distance thereof due to the disability
- Acute life-threatening illness or sudden need for care of a parent of the applicant or their spouse, up to a duration of one year
- School education or first vocational training of the spouse or registered partner in corresponding application of No. 3
- Construction or purchase of a home or condominium at the new place of employment, if the related preparations or contract negotiations have already progressed to such an extent that the entitled person can no longer reasonably be expected to withdraw from the construction project or the purchase contract.
In this cases you do not have to show your efforts in finding suitable housing!
