Einhaltung der deutschen Exportkontroll-Verordnungen

Der Außenwirtschaftsverkehr unterliegt gewissen Einschränkungen, die sich aus dem Recht der EU und aus dem Außenwirtschaftsgesetz (AWG) sowie der Außenwirtschaftsverordnung (AWV) ergeben. Auch die Nutzung der High-Performance-Computing - Ressourcen (im folgenden HPC-Ressourcen) der Universität Augsburg unterliegt den Exportkontroll-Verordnungen.

Die Universität-Augsburg muss die Einhaltung der Exportkontroll-Vereinbarungen an allen Punkten, an denen Zugang zu HPC-Ressourcen vergeben wird, entsprechend umsetzen. Daher müssen die Leitung eines HPC-Projekts, für das Ressourcen beantragt werden, sowie alle Nutzer/-innen mit Zugangsberechtigung zu diesen Ressourcen eine entsprechende Erklärung abgeben.

Die Leitung eines HPC-Projekts (Leiter/-in und eventuell Kontaktperson) muss die Erklärung zur Einhaltung der deutschen Exportkontroll-Verordnungen im Rahmen der Beantragung eines HPC-Projekts im Jira-Portal der Universität Augsburg explizit bestätigen. Eine entsprechende Erklärung müssen auch die Nutzer/-innen bei der Beantragung der Nutzung von HPC-Ressourcen auch explizit bestätigen.

Die Erklärungen haben folgenden Wortlaut:

• Leitung des HPC-Projekts: Erklärung zur Einhaltung der deutschen Exportkontroll-Verordnungen (Leitung von HPC-Projekten)
• Ansprechpartner/-in: Erklärung zur Einhaltung der deutschen Exportkontroll-Verordnungen (Kontaktperson)
• Endnutzer/-in: Erklärung zur Einhaltung der deutschen Exportkontroll-Verordnungen (Endnutzer/-in)

Compliance with German Export Control Regulations

Foreign trade is subject to a number of restrictions stemming from EU legislation as well as the provisions of the Foreign Trade and Payments Act (Außenwirtschaftsgesetz) and its implementation, the Foreign Trade and Payments Ordinance (Außenwirtschaftsverordnung). Usage of the University of Augsburg high-performance-computing resources (in the following HPC resources) is subject to the export control regulations, too.

These export control regulations apply also to the use of the University of Augsburg HPC resorces. The University of Augsburg is obligated to implement these export control regulations whenever access is granted to one of its HPC resources. Hence, all HPC project managers (owner and eventually contact user) asking for access to University of Augsburg HPC resources and all end users must submit corresponding compliance declarations.

The management of an HPC project (owner and eventually contact person) must explicitly confirm the Declaration of Compliance with German Export Control Regulations when applying for an HPC project in the Jira portal of the University of Augsburg. Users must also explicitly confirm a corresponding declaration when applying for the use of HPC resources.

• Head of HPC-project: Declaration of Compliance with German Export Control Regulations (HPC-project manager)
• Contact User: Declaration of Compliance with German Export Control Regulations (Contact User)
• End user: Declaration of Compliance with German Export Control Regulations (End User)
